CPS Records
Texas law allows any child who was in foster care or the subject of an investigation a copy of the records related to the investigation once they become an adult. Unfortunately requests for these records are usually ignored by CPS and most former foster youth never are able to get their records. The Texas Foster Youth Justice Project is can help you get your records.
Some things you should know about getting your CPS records:
- CPS has the right to black out certain information that is considered confidential under the law.
- There is no charge for the first set of records for a former foster youth, but you will be charged if you try to get a second copy.
- The process can take a long time, even more than a year. You need to keep your address and phone number updated with either the Texas Foster Youth Justice Project, if they are helping you, or the CPS record request office.
- Reviewing your records can be a painful process. It may bring back bad memories. There may be negative comments about you. It is important that you review the records with a counselor, case manager or someone with some experience in providing emotional support.
